Summer is traditionally a quiet time in Florida when seasonal visitors head north to enjoy family and friends. This summer, however, is a bit different. As Southwest Florida grows, so does the demand for affordable workforce housing. Right now is a great time for residents to trade up -- by selling a smaller condo or patio home and purchasing a dream home at a great price.  While there are plenty of terrific buys on the market, prospective sellers looking to move up are facing a dilemma. Ask Carla!

As we come across interesting questions raised by clients and colleagues, we will publish them with our response for your viewing. Many questions have reoccurring themes and some are very specific -- we hope you will be able to use the information in some way or you may just choose to keep it for reference material.

Dear Carla,

We are having a terrible time finding a buyer for our house even though we have reduced our asking price several times. We have to move for my husband’s job and we need to sell our home very quickly.

We listed the house with a real estate agent for six months, but the listing expired last month. Just last week we received a call from someone who toured our house when the agent advertised it. The interested party also called our previous agent last week, but she explained that she no longer has the listing.  He got our number from the telephone book.

The potential buyer wants to see the house again and sounds very interested in buying it.  He also has mentioned the money we would both save by not paying a commission to a real estate agent.

Yesterday, our previous agent called to tell us about the call from the potential buyer. She said that she had negotiated with him previously, but I know his name was not on the potential buyer list that we received when the listing expired. What should we do?

Dear Jane and Steve,

Once a listing expires, the agent must provide a list of potential buyers for whom they have interacted. However, a real estate agent’s entitlement to be paid occurs when the agent is the “procuring cause of sale.” This means a buyer who is “ready, able, and willing” is found through his or her efforts. Those efforts include, but are not limited to advertisements, front yard signs, face to face contact or written correspondence with potential buyers, or open houses and other showings.

If it is very clear that one of the potential buyers on the list purchases the property within a specified period of time, usually six months, then a commission is owed. In this case, it appears that your agent neglected to include this potential buyer on the list, but the potential buyer did re-contact the agent. .

Keep in mind that the role of an agent reaches far beyond finding the buyer. He or she assures that the contract is properly drawn, helps you negotiate the price, guides you through counter offers, and makes the path to closing smoother.

Before you make your decision, talk the details of this situation over with an attorney who can help you determine if you are legally obligated to pay the commission. The wrong decision may cause the agent to initiate legal action.  The right decision may be more expensive, but morally correct.

Gone phishing!

Some may have received an e-mail like the one shown below.  Please note that this is a "phishing" email, in other words, a fraudulent attempt to obtain your personal information.

How can I tell this is a fraudulent/phishing email?

1) Because it is unsolicited and it is asking you to log in to a web site to "restore your account access" (and obtain your personal information in that process)
2) The web site they are asking you to log on to is not your bank’s

But I do not have an account with the bank mentioned in the email.  Why did I get this email?

In most cases, the "phishers" do not have access to any information from the "target" financial institution and are just hoping that someone in their distribution list is a client of the "target" financial institution and will fall into the trap.

How did they get my email address?

This is no different than any other type of spam (junk email).  Many web sites you register at sell the emails they collect from their clients to spammers and spammer do "brute force attacks" (i.e., they try every possible combination of names "@" registered domains on the internet). 

Be careful, never give out personal information without first knowing that the request is legitimate and that you have authorized the request in the first place.

Enjoy a Stress Free Summer

We all look forward to summer - lounging by the pool, basking in the sunshine at the beach, or taking the family on a vacation. But the summer doesn't always bring rest and relaxation. It also brings its own problems and stresses. So, how can you unplug, unwind, and enjoy summer with less stress than ever? It takes practice and patience to juggle the stress from family, home, and work. Here are some tips that may work for you.

  • Take a Break: Make time for a mini-retreat from the stress of the office. At your desk, close your eyes and practice deep breathing or relaxation techniques. Just a couple of quiet moments can make a huge difference.
  • Relax: Learn to relax your muscles. Contract and release muscles, one at a time, to achieve deep relaxation.
  • Harness Your Creativity: Use your imagination to relieve some tension. Paint, write, draw, or play an instrument --anything that gets the creative juices flowing.
  • Allow Time to Worry: Get control over your worries. Worry about family, finances, and work can be a source of considerable stress. Set aside a specific time for them each day, instead of worrying about problems all day.
  • Create a Stress-Free Zone: Create a special retreat for your relaxation techniques. This stress-free zone could be anything from an entire room to just a small corner of one. Make it as serene as possible.
  • Move: Make time for daily exercise. A regular exercise regimen is good for your physical and mental well-being. It not only reduces the effects of stress, but it also helps you lose weight, helps keep the intestines working properly, and reduces the risk of cancer, diabetes, and other diseases.

How to Increase Your Contributions Deduction - Legally

We are already well into the 2006 tax year and it’s a good time to remind ourselves about a few things that will help us at the end of the year. Charitable contributions are one of those things that can be truly produce a "win-win" situation. They provide you an opportunity to give of your resources to a worthy cause. At the same time, they can reduce your tax liability if you follow a few rules.

Are you missing out on an easy deduction by failing to report gifts of non-cash items to charities, or by overlooking your out-of-pocket expenses for charitable work? When you give clothing and other household items to charity, take the time to prepare a list of the items given for each date that you contributed, and attach a receipt from the charity, with its name and address, acknowledging receipt of the items. Include the fair market value of each item. What's the fair market value? Often, the receipt you get will have a list on the back with estimated values of certain items. Or, you can go down to your local thrift store and check out their selling prices. There are also companies that specialize in the valuation of items given to charity, one of which is William Lewis' Client Valuation Services. They have published a booklet containing hundreds of average current values. Visit their website, at www.taxsave.com, for more information.

As for that car you no longer need, Kelley Blue Book has a website (kelleybluebook.com) where you can enter information about a vehicle and find its value. You only need a copy of an original purchase receipt when you give a new, never-used item, such as canned food for a food drive. In this case, you're allowed to deduct what you paid for the item. Does this seem like too much work? You'll be surprised at the value of your used things. Other non-cash contributions include items purchased or amounts spent in helping charities do their work. Do you sing in the choir? Did you know that driving to church to rehearse is deductible, at $.14/mile?

You might also be required to purchase sheet music, hymnals, robes, and other items - the cost of these is also deductible. While you can't get a deduction for the value of the time you have spent, you are entitled to claim your "out-of-pocket" expenses for these things, so keep the receipts and add them up for your tax preparer. Even if you don't have a receipt, a calendar reference, showing how much, where, when, and what you purchased, may be sufficient to allow the deduction. Keep your auto mileage with calendar references for where, when, and how many miles you drove for any other charity work you might do, such as scouts, little league, etc. You are allowed a mileage deduction for charitable miles driven to do your work - but not just to chauffeur your kids to events. You have to be a leader, or a coach, or an assistant, or something like that. Another area often overlooked is lodging and food when out of town at a church convention or other affair where you donated your time and money to do charitable work.

Finally, many small businesses or their owners contribute to charities when they could advertise, in church bulletins or other charitable publications, such as a supporter booklet for a private school. Advertising often provides a much higher deduction than charitable giving. With these matters, as in all others, consult your tax professional to provide you with guidance in getting the most out of your charitable deductions.

How To Prepare Your Home For Hurricane Season

It is that time of year again. Hurricane season begins June 1st and lasts until November 30th. Experts predict another active season and they say now is the time to prepare your home and your family for a possible storm.

To get your home ready, trim bushes or trees and remove diseased and damaged limbs, making them more wind resistant. Also, remove coconuts from palm trees because they could become projectiles during a hurricane. Consider additional wind protection for your home. If you do not already have hurricane shutters, you may want to purchase them. Or, you may want to get ½ inch precut outdoor plywood boards to cover your windows and doors.

Create a personal evacuation plan, identifying where you would go if you are forced to evacuate. Plan alternate routes and get a map -- in case roadways are clogged with traffic during an evacuation. Decide what to do with pets, if you have to evacuate.

Stock a disaster supplies kit. Make sure it includes non-perishable food items, a can opener, three gallons of water per person, a battery powered radio, flashlights, batteries, and protective rain gear. Also, do not forget a first aid kit and essential medications.

Make a comprehensive list of the contents of your home. Take pictures or make a video, showing every room of your home. Insurance will need a detailed description of any items damaged or destroyed during a storm.

Finally, check your insurance policy. Many homes in the Naples/Fort Myers area have appreciated dramatically in the past several years, so make sure you have enough insurance to cover both the structure and its contents. Remember, most insurance policies do not cover flood damage –even if it is from a hurricane.

Time Saving Tip

When Buying a Home…
It can take weeks or months to find the right home for you and your family --and once you locate the perfect place you can’t wait for moving day. But these plans can be slowed down or derailed all together if you don’t plan ahead. Never begin a home search until you determine how much house you can afford.There are many mortgage calculators that are designed to help you figure out monthly payments, based on the mortgage amount, the mortgage term, and the interest rate. Once you figure out your home purchasing power, then you should shop around for the best rates and programs. Finally, get pre-approved for a mortgage. This step saves time for you and your realtor, narrowing the price range to search. Remember, if you are willing to take your time finding the perfect home, you also should be willing to take the time to prepare for the responsibility of financing a new home.
